TOWNSHIP OF CHESTERFIELD

ORDINANCE 2008 –3 

AN ORDINANCE ESTABLISHING AND CREATING THE POSITION OF SEWER MAINTENANCE DIRECTOR WITHIN THE TOWNSHIP OF CHESTERFIELD 

          WHEREAS, the Township Committee operates its own municipal sewer system in accordance with the provisions of Chapter 216-10, et. seq. of the Code of the Township of Chesterfield; and 

          WHEREAS, sufficient users have now “tied into” the Township’s sewer system to warrant the establishment and creation of the position of Sewer Maintenance Director; 

          NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Township Committee of the Township of Chesterfield, County of Burlington and State of New Jersey as follows: 

ARTICLE I.  AMENDED ORDINANCE:  CREATION OF POSITION OF SEWER MAINTENANCE DIRECTOR 

There is hereby established and created the position of “Sewer Maintenance Director”

who shall perform such duties and meet such responsibilities as may, from time to time, be established by the Township Committee through its adoption of a job specification / job description.  Generally, however, the Sewer Maintenance Director shall supervise and be responsible for the cleaning and maintenance of storm and sanitary sewers, catch basins and other drainage facilities; investigate complaints regarding the sewer system and see that corrective action is taken; obtain sewer safeguard and supervise the use of equipment, materials and supplies related to the sewer system operation; and report to the Township Committee and the Township Engineer any issues that may be required other than routine maintenance and / or implicate policy issues for which only the governing body and the Township Engineer can make decisions. 

          ARTICLE II.  SALARIES, WAGES AND COMPENSATION 

          The salary of the Sewer Maintenance Director shall be established by the annual Salary Ordinance. 

          ARTICLE III.  REPEALER, SEVERABILITY AND EFFECTIVE DATE. 

A.              Repealer.  Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies. 

B.               Severability.  In the event that any clause, section, paragraph or sentence of this Ordinance is deemed to be invalid or unenforceable for any reason, then the Township Committee hereby declares its intent that the balance of the Ordinance not affected by said invalidity shall remain in full force and effect to the extent that it allows the Township to meet the goals of the Ordinance. 

C.                Effective Date.  This Ordinance shall take effect upon proper passage in accordance with the law. 

CHESTERFIELD TOWNSHIP COMMITTEE  

NOTICE IS HEREBY GIVEN by the Township Committee of the Township of Chesterfield that the Ordinance to which this notice is attached was introduced on first reading at the regularly scheduled meeting of the Township Committee held March 12, 2008.  It will be further considered by the Township Committee at a meeting to be held at the Municipal Complex, 300 Bordentown-Chesterfield Road in Chesterfield Township on March 27, 2008 at 7:30 PM, or at any subsequent meeting to which consideration of the matter is adjourned..  The Ordinance may be reviewed and/or a copy obtained upon the payment of the appropriate fee at the Office of the Township Clerk during the hours of Monday through Friday, 9:00 AM to 4:00 PM.  At the time the Township Committee further considers the Ordinance, and prior to action being taken, the Township Committee will hold a public hearing during which all interested in the Ordinance will be afforded an opportunity to speak, or otherwise exercise the rights which they enjoy under the laws of the State of New Jersey.  After such a hearing, the Township Committee may adopt, amend, or reject the Ordinance at issue.
