TOWNSHIP OF CHESTERFIELD

ORDINANCE 2008 –4 

AN ORDINANCE REPEALING THE PROVISIONS OF SECTION 39-15 OF THE CODE OF THE TOWNSHIP OF CHESTERFIELD RELATING TO THE CHESTERFIELD TOWNSHIP MUNICIPAL COURT, TO ALLOW FOR THE MUNICIPALITY TO ENTER INTO AN AGREEMENT WITH NEIGHBORING MUNICIPALITIES FOR A SHARED MUNICIPAL COURT PURSUANT TO N.J.S.A. 2B:12-1 ET. SEQ. 

          WHEREAS, the Township Committee has, for more than one year, studied the feasibility and relative benefits and disadvantages of eliminating the current Municipal Court and entering into a Shared Service Agreement with other municipalities for a shared Municipal Court in accordance with the provisions of N.J.S.A. 2B:12-1 et. seq.; and

          WHEREAS, the Borough of Wrightstown and the Township of North Hanover are currently parties to such a Shared Municipal Court Agreement, and the Township Committee has reviewed the Agreement between those two (2) municipalities, and has determined that it is beneficial and in the public interest to join those municipalities in participating in a shared Municipal Court; and

          WHEREAS, although the Chesterfield Township Municipal Court has served the residents of this Township well, the increased and heightened need for security for the Municipal Court Judge and the Municipal Court personnel, is a matter of great concern to the governing body, and given the physical limitations of the municipal building, the costs attendant to addressing even minimal security requirements would exceed $25,000.00, and would not meet all of the security requirements to which a Municipal Court is entitled and which it deserves; and

          WHEREAS, the public interest is advanced by participation with adjoining municipalities in various forms of shared services, and the Township’s discussions with North Hanover Township indicate that not only would the Township of Chesterfield not have to spend money to address legitimate security concerns, but would actually increase revenues by approximately Sixteen Thousand Dollars ($16,000.00) per annum, with said sum more than likely increasing after the first year; and

          WHEREAS, for both reasons of security, efficiency and economy, the Township Committee has determined that it is in the best interest of the municipality to eliminate the Chesterfield Township Municipal Court in favor of entering into an Interlocal Services Agreement with North Hanover Township and the Borough of Wrightstown for a shared Municipal Court pursuant to N.J.S.A. 2B:12-1 et. seq.;

          NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Township Committee of the Township of Chesterfield, County of Burlington and State of New Jersey as follows:

          ARTICLE I.          REPEALED SECTION.

          Section 39-15 of the Code of the Township of Chesterfield entitled “Municipal Court: establishment; positions; compensation”, is hereby repealed in its entirety.

          ARTICLE II.          EFFECTIVE DATE.

          Effective Date.  This Ordinance shall take effect on the thirtieth day following adoption of a Resolution by the governing body authorizing the execution of an Agreement, or an amendment to any existing Agreement, between the Township of North Hanover, the Borough of Wrightstown, and the Township of Chesterfield establishing a shared Municipal Court by and between the three (3) municipalities. 

CHESTERFIELD TOWNSHIP COMMITTEE

NOTICE IS HEREBY GIVEN by the Township Committee of the Township of Chesterfield that the Ordinance to which this notice is attached was introduced on first reading at the regularly scheduled meeting of the Township Committee held March 12, 2008.  It will be further considered by the Township Committee at a meeting to be held at the Municipal Complex, 300 Bordentown-Chesterfield Road in Chesterfield Township on March 27, 2008 at 7:30 PM, or at any subsequent meeting to which consideration of the matter is adjourned..  The Ordinance may be reviewed and/or a copy obtained upon the payment of the appropriate fee at the Office of the Township Clerk during the hours of Monday through Friday, 9:00 AM to 4:00 PM.  At the time the Township Committee further considers the Ordinance, and prior to action being taken, the Township Committee will hold a public hearing during which all interested in the Ordinance will be afforded an opportunity to speak, or otherwise exercise the rights which they enjoy under the laws of the State of New Jersey.  After such a hearing, the Township Committee may adopt, amend, or reject the Ordinance at issue.
