CHESTERFIELD TOWNSHIP ORDINANCE 2008-8 AUTHORIZING TRANSFER OF PROPERTY AT BLOCK 202.107, LOTS 9 AND 11 (PREVIOUSLY PART OF BLOCK 202, LOTS 28.01 AND 28.02) REFERRED TO AS THE WILKINSON PROPERTY TO THE CHESTERFIELD TOWNSHIP BOARD OF EDUCATION WHEREAS, the Township Committee of the Township of Chesterfield (“Township”) previously purchased Block 202, Lots 28.01 and 28.02, referred to generally as the Wilkinson Farm, on October 31, 2007; and WHEREAS, the total acreage of the Township’s acquisition was approximately 27 acres; and WHEREAS, the Township acquired the acreage with the intention of severing approximately 8.73 acres for use by the Chesterfield Township Board of Education (“Board”); and WHEREAS, the Township applied to the Chesterfield Township Planning Board and, at a public hearing on March 25, 2008, obtained approval to subdivide Block 202, Lots 28.01 and 28.02 into four separate lots, referred to as Block 202.107, Lot 8 (8.95 acres), Block 202.107, Lot 9 (6.77 acres), Block 202.107, Lot 10 (7.94 acres), and Block 202.107, Lot 11 (2.03 acres); and WHEREAS, the Township desires to transfer, for nominal consideration, the property at Block 202.107, Lots 9 and 11 (totaling 8.73 acres); and WHEREAS, the Township is authorized to transfer property for nominal consideration to a board of education for education purposes pursuant to the Local Lands and Buildings Law, at N.J.S.A. 40A:12-19;
NOW, THEREFORE, BE IT HEREBY ORDAINED by the Township Committee of the Township of Chesterfield, County of Burlington, State of New Jersey that Block 202.107, Lot 9 (6.77 acres) and Block 202.107, Lot 11 (2.03 acres), totaling 8.73 acres, shall be transferred to the Chesterfield Township Board of Education for nominal consideration to be used for the new school site and associated drainage improvements.
